The U.S. Food and Drug Administration (FDA) posted the following updates on their website concerning the new FSMA Biennial Registration Renewal requirement for Food Facilities:
– The FSMA Biennial Food Registration Renewal period will close on January 31, 2013. If you are required to renew your food facility under FSMA and do not do so by January 31, 2013, you will need to re-register.
– Due to certain confidentiality constraints and the amount of time it takes the Agency to process PIN requests, the Agency is no longer able to fulfill PIN requests for FSMA registration renewals for the 2012 renewal period. If a facility is unable to renew its existing registration by January 31, 2013 because it does not have its PIN number, the facility may create a new registration by January 31, 2013 in order to be registered in accordance with section 415 of the FD&C Act.
The U.S. FDA regulates most food and beverage products sold in the United States. Companies selling these products must meet very specific requirements set-forth by the U.S. Federal Food, Drug and Cosmetic Act, which was originally passed by the U.S. Congress in 1938 and has subsequently been amended by Acts such as the Bioterrorism Act in 2002 and more recently by the Food Safety Modernization Act (FSMA) in 2011.
FSMA requires food facilities to register with the U.S. FDA and to renew their registrations during the period of October 1 and December 31 of each even-numbered year. However, in December 2012, FDA issued guidance stating that because there was a delay in FDA’s implementation of FSMA biennial registration renewal for the 2012 cycle, FDA intends to exercise enforcement discretion with respect to registration renewals submitted to FDA after December 31, 2012 for a period of 31 days, until January 31, 2013.
