USDA Label Approval

USDA CITATION: 9 C.F.R. § 412 (2017)

The United States Department of Agriculture (USDA) requires approval of certain labels for meat and poultry products. Among other aspects, more than fifty types of special statements and claims subject labels to USDA approval. A few examples include:

  • Voluntary allergen advisory statements (“made in a facility that also processes,” “may contain,” etc.)
  • Breed claims (Angus, Berkshire, etc.)
  • Certain “Certified” claims (certified organic, certified Halal, etc.)
  • Organic and Natural claims (organic, all natural, made with natural ingredients, etc.)
  • Negative or “Free” claims (no additives, no animal by-products, gluten free, etc.)
