Although FDA’s Food Facility Registration Module (FFRM) system has included an email field ever since FDA began using the system in October 2003, it was an optional field until the passage of the Food Safety Modernization Act (FSMA). FSMA requires that food facility registrations include the e-mail address for the contact person of the facility or, in the case of a foreign facility, the United States agent for the facility. The requirement now is in effect and companies which have not listed e-mail addresses, or which may have listed a now-defunct email address, are in violation of the law (FSMA Section 102 (a) (1) (a), codified at 21 U.S.C. sec. 350d (a)(2)).
Many food facilities did not include an email address for the contact person of the facility or, in the case of a foreign facility, the United States agent when they originally registered with FDA. Further, many facilities that provided email addresses in the FFRM no longer use those addresses. In addition to being in violation of the law, companies may miss important notices from FDA.
